Goods in the TIDEMARK online shop are sold by a company based in Hungary:

In these terms, “we” and “us” mean this company, and “you” means the person who orders. A consumer is a natural person who orders for purposes outside their trade, business, craft or profession.
2. Scope
These terms apply to every order you place in the TIDEMARK online shop. The contract language is English. You can read, save and print these terms before you order.
If you are a consumer, nothing in these terms limits the mandatory consumer protection rules of the country where you live.
3. Orders and contract formation
To order, you choose the items, sizes and quantities, add them to your cart, and follow the checkout: you enter your delivery and billing details, choose a delivery method and a payment method, and place the order. Before you place the order, you can check your entries in the order summary and correct them.
By placing the order, you make us an offer to buy the items. The contract is concluded when we confirm your order to you. We confirm your order after your payment has been accepted (see Payment).
We may refuse an order, or cancel it before we confirm it, for stated reasons such as:
- An item is not available because of an error in our stock records
- An obvious error in the price or in the product information
- Your payment is not accepted
- We reasonably suspect fraud or misuse
- The delivery address is in a destination we do not deliver to
If we refuse an order after you have been charged, we tell you and refund the full amount, using the payment method you used.
4. Prices and VAT
Prices are in euro and are shown including VAT where applicable. Delivery costs are not part of the item price. They are shown at checkout, before you pay, together with the total.
For destinations outside the European Union, customs duties and import charges may apply. See Delivery and returns, section 5.
5. Payment
You can pay by Visa, Mastercard, American Express, PayPal, Apple Pay or Google Pay. How and when you are charged is described on the Payment page. Payment is made when you place the order.
6. Delivery
We ship from Hungary. The countries we deliver to, the shipping methods, the costs and the delivery times are described on the page Delivery and returns and shown at checkout before you pay.
If we do not deliver by the time stated at checkout, the statutory rules on late delivery apply (Art. 18 of Directive 2011/83/EU). If you are a consumer, the risk of loss of or damage to the goods passes to you when you, or a third party you named other than the carrier, take physical possession of them.
7. Right of withdrawal
If you are a consumer, you may withdraw from the contract within 14 days, without giving any reason. The 14 days start on the day you receive the goods. To withdraw, send us a clear statement by e-mail to hello@tidemark.site, and return the goods within 14 days after your withdrawal. We refund you within 14 days of receiving your withdrawal.
Statutory exceptions to the right of withdrawal apply, for example to goods made to your specifications.

8. Legal guarantee
The goods we deliver must conform to the contract. We are liable for any lack of conformity that exists when the goods are delivered and becomes apparent within the statutory liability period, which is at least two years from delivery.
If the goods do not conform, you have the remedies that the law provides: repair or replacement, and, where the conditions are met, a reduction of the price or termination of the contract.
Your statutory rights under Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods, and under the applicable law, are not affected by these terms.

9. Liability
Nothing in these terms excludes or limits our liability for death or personal injury, for damage caused intentionally or by fraud, or for anything else that cannot be excluded or limited under mandatory law. In all other cases, our liability is governed by the applicable law.
10. Complaints and disputes
If you have a complaint, write to hello@tidemark.site. We will answer it without undue delay and within the periods set by the applicable law.
If you are a consumer and we cannot settle a dispute with you, you may turn to the conciliation body competent for the seller's registered seat: Veszprém County Conciliation Board (Veszprém Vármegyei Békéltető Testület). You may also contact the consumer protection authority of your country of residence.
Hungarian law applies to the contract. If you are a consumer, this does not take away the mandatory consumer protection that you have under the law of the country where you live.

11. Changes
We may change these terms, for example when the law or our shop changes. The version that applies to your order is the one in force when you place it. A change does not affect orders already placed. The date of the current version is shown at the top of this page.
